Can a mutual exchange be refused?
There are, by law, 11 grounds on which the Local Authority or Housing Association can withhold or refuse consent to a mutual exchange: Ground 1: There is a Possession Order on the property. Ground 2: A Notice of Seeking Possession has been served. Ground 5: The property is tied accommodation.
Can you pull out of a mutual exchange?
Please remember that all parties (including you) have a legal right to pull out of a mutual exchange at any point before signing the paperwork. This rarely happens as most people do genuinely want to home swap, however, it is something to remain aware of.
